1. Introduction and Acceptance of Terms
Welcome to RideSafe ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to the RideSafe mobile application, website, and related services (collectively, the "Service").
The processing of users' personal data is carried out in accordance with the RideSafe Privacy Policy, which is a separate document and constitutes an integral part of the Service usage rules regarding personal data processing.
By accessing or using the Service, you agree to comply with these Terms. If you do not agree with the Terms, you may not use the Service. We reserve the right to modify them. We may modify these Terms in the manner specified in Section 14 of these Terms. Material changes take effect after their publication in the Service or on the website and/or after notifying the user, if such notification is necessary given the nature of the changes. Continued use of the Service after the updated Terms take effect constitutes the user's agreement to such changes.
2. Service Description
RideSafe is a ridesharing service that connects passengers and drivers for intercity travel with an emphasis on user verification. The Service includes:
- matching passengers and drivers with similar routes
- facilitating communication between users
- subscription purchase and management
- safety features and verification
- reviews and ratings
RideSafe is a technology intermediary platform that helps passengers and drivers find each other for shared intercity rides. RideSafe is not a carrier, transport company, taxi service, dispatch service, agent, representative, employer of the driver, or a party to a transportation contract or other arrangement between the driver and the passenger.
We do not own vehicles, do not hire drivers, do not control the actual completion of rides, do not guarantee their completion, safety, quality, route, arrival time, vehicle condition, or user behavior. All arrangements regarding a specific ride arise directly between the driver and the passenger.
2.1. User Roles
Within the Service, a user may act as a passenger, driver, volunteer, or other person interacting with the Service.
A passenger may search for rides, submit requests to join rides, interact with drivers, make subscription payments, and pay for rides directly to the driver.
A driver may create rides, set the route, number of seats, passenger participation conditions, ride cost share, and provide payment details for direct payment from passengers.
A volunteer or other person may submit applications or requests through the Service or website, if such functionality is available.
3. User Accounts and Responsibilities
3.1. Account Creation
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
During registration or use of the Service, we may require phone number verification using a one-time SMS code. The cost of SMS, mobile internet, or other communication services that may be charged by your carrier is borne by the user.
3.2. Age Requirements
The Service is intended for persons aged 18 and older. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. During registration or first use of certain features, the Service may require confirmation via a checkbox "I am 18 years old" with recording of the date, time, and technical identifier of such confirmation.
If you are under 18, you do not have the right to independently book, pay for, offer rides, or use the Service as a full user. A minor may participate in a ride only if the booking is made by one of the parents or a legal guardian through their account. In the future, the Service may provide a separate limited functionality for minors participating in a ride booked by one of the parents or a legal guardian. Such functionality, if made available in the Service, will not grant the minor the right to independently book, pay for, or offer rides. We may restrict or terminate access to the Service if we receive information or have reasonable grounds to believe that the user violates age requirements.
3.3. Driver Requirements
The driver is solely responsible for the legality, safety, and proper completion of the ride they offer through the Service.
By using the Service as a driver, you represent and warrant that:
- you hold a valid driver's license of the appropriate category
- you have the legal right to operate the vehicle used for the ride
- the vehicle is technically sound, roadworthy, and complies with legal requirements
- you have a valid insurance policy and other documents required by law
- you will comply with traffic rules, safety requirements, passenger transportation rules, and other legal requirements
- you are solely responsible for any consequences related to operating the vehicle, vehicle condition, documents, insurance coverage, route, stops, and actual ride completion
RideSafe may require the driver to undergo verification, provide certain data or documents; however, such verification does not mean that RideSafe confirms the validity of the driver's license, insurance policy, vehicle technical condition, or the driver's right to make a specific ride, unless otherwise expressly stated in the Service.
3.3.1. Verification Through Diia
For user identity verification, RideSafe may use integration with Diia. As a result of such verification, RideSafe receives the user's full name and TIN/RNOKPP, as well as other information transmitted by Diia within the relevant verification scenario. Technical data from Diia's response, including electronic signature/technical confirmation, may be stored in encrypted form in accordance with the Privacy Policy.
Verification through Diia confirms the user's identity within the data available to RideSafe, but does not constitute confirmation of a valid driver's license, insurance, vehicle technical condition, or proper fulfillment of the driver's obligations.
3.3.2. Verification of Other Documents
If the Service allows or requires entry of driver's license, insurance policy, vehicle, or other document data, such data may be provided by the driver themselves. Unless otherwise expressly stated, RideSafe does not verify such data against government registries, police databases, insurance registries, or other official sources.
The driver is solely responsible for the accuracy, currency, and legality of the documents and information provided.
3.3.3. Taxes and Driver Income
The driver is solely responsible for declaring and paying any taxes, fees, or other mandatory payments that may arise in connection with receiving funds from passengers. RideSafe is not the driver's tax agent for ride payments, does not withhold taxes from such amounts, and does not file reports on behalf of the driver, unless otherwise directly required by law.
3.4. User Obligations
You agree to:
- provide truthful information and update it as needed
- use the Service in compliance with applicable laws
- communicate courteously and respectfully with other users
- use contact details, payment information, and other information of other users exclusively for organizing, completing, or paying for a confirmed ride
- report safety concerns or inappropriate behavior
- not disclose other users' data obtained through the Service to third parties
- not transfer, sell, lend, use another person's account, or allow another person to use your account, except as expressly provided by the future limited Service functionality for accompanying a minor, if such functionality is made available
- not use the Service for fraud, spam, harassment, discrimination, pressure, threats, or collecting information about other users
- comply with ride arrangements, promptly notify about cancellations or material changes
- maintain valid vehicle insurance (for drivers)
4. Prohibited Activities
You agree not to engage in the following:
- using another user's phone number, email, payment details, card, IBAN, or other data for any purpose unrelated to a confirmed ride
- publishing, copying, disclosing to third parties, or storing beyond necessity the contact or payment data of other users
- demanding payment that was not agreed with the passenger, or misleading the user about ride cost
- providing false information about payment, payment confirmation, route, vehicle, or the identity of the driver/passenger
- creating rides that are not actually planned, or using the Service for fraudulent, fictitious, or manipulative actions
- circumventing technical or security restrictions of the Service, interfering with the mobile app, API, payment, or verification mechanisms
- using the Service for illegal purposes or in violation of law
- harassing, threatening, or harming other users
- providing false or misleading information
- impersonating another person or organization
- using someone else's account, creating or using duplicate accounts to circumvent blocking, negative reviews, ratings, complaint history, subscription restrictions, or other Service rules
- circumventing payment or subscription mechanisms
- interfering with the operation of the Service, servers, or network
- collecting or scraping other users' data without permission
- using automated means to access the Service without permission
- using the Service to circumvent subscription, safety, verification rules, or Service-established procedures for driver-passenger interaction
- using the Service to transport illegal goods or substances
5. Payments and Subscriptions
5.1. Subscription Plans
RideSafe offers subscriptions for passengers and drivers on a regular paid feature access model similar to subscription services: the user selects a plan, pays for the corresponding access period, and the subscription automatically renews until cancelled. Payment is made monthly or annually depending on the selected plan. All prices, available features, next billing date, and cancellation terms are displayed in the app and may change with prior notice in accordance with these Terms.
5.2. Payment Processing
Subscription payments for RideSafe are processed through the payment provider Hutko and/or other payment instruments available in the Service, including Apple Pay, Google Pay, or Google Play Billing, if available to the user.
RideSafe does not store the full payment card number for subscription payments. Payment data processing is carried out by the payment provider in accordance with its rules and security requirements. RideSafe may receive and store information about payment status, transaction identifiers, recurring payment token, token expiration date, card type, bank, bank country, payment system, IP address, and other technical data necessary for accounting, confirmation, renewal, or cancellation of the subscription.
You agree that the selected payment method may be used for automatic subscription renewal until cancelled in accordance with these Terms.
5.2.1. RideSafe Service Fee
RideSafe may charge the user a separate service fee for use of the Service, booking, access to specific functionality, ride participation confirmation, or another service action, even if payment for the ride itself is made by the passenger directly to the driver outside RideSafe's payment infrastructure. The service fee is a payment for RideSafe's services as a technology platform and is not: a ride payment, driver compensation, transportation fee, or funds that RideSafe accepts, holds, or transfers to the driver. The amount, timing of the charge, cancellation procedure, and possibility of refund of the service fee are displayed in the Service or communicated to the user before payment, if such a fee applies.
5.3. Ride Payments
RideSafe does not accept, hold, transfer, or process funds for rides between passengers and drivers. Payment for a specific ride is made directly between the passenger and the driver outside RideSafe's payment infrastructure, including by direct transfer to the driver's payment details or another method agreed between such users. RideSafe only stores and displays the driver's details within the Service functionality for a confirmed ride. Payment of the RideSafe service fee, if such a fee applies, is a separate payment for use of the Service and does not change the direct nature of settlements between the passenger and the driver for the ride itself.
RideSafe is not a payment intermediary, payment services operator, electronic money issuer, financial institution, money transfer agent, escrow service, tax agent, or primary financial monitoring entity for direct payments between passengers and drivers, unless otherwise directly established by law or a change in the Service's operating model.
Any disputes regarding the fact, amount, timing, method, or return of ride payment are resolved directly between the passenger and the driver. RideSafe may provide technical or informational support within the Service functionality but does not guarantee payment, refunds, compensation, or fulfillment of financial arrangements between users.
5.3.1. Driver Payment Details
To receive direct payment from passengers, the driver may provide RideSafe with their payment details, including payment card number or IBAN, during registration, profile setup, or changes. Such details are used exclusively to display them to the passenger with whom the driver has a confirmed ride for direct payment. The bank or payment provider may process full banking details; however, RideSafe stores them using encryption and does not display the full account number/full details in plain text without proper grounds.
RideSafe stores such data in encrypted form if stored on RideSafe servers and may temporarily store them in the driver's secure device storage during registration or driver profile setup. After the need to display the details ends, full data is cleared or restricted, and masked data or technical identifiers may be retained longer for security, disputes, auditing, or fraud prevention.
The passenger has the right to use the driver's payment details exclusively for paying for a confirmed ride. Any other use, copying, distribution, publication, or disclosure of such details to third parties is prohibited.
5.4. Auto-Renewal
The subscription automatically renews for the next billing period unless the user cancels it before the next billing date. The next billing date, subscription cost, and available cancellation methods are displayed in the Service or in the settings of the relevant app store/payment instrument if payment is made through such instrument.
After subscription cancellation, access to paid features is maintained until the end of the already paid period, unless otherwise expressly stated in the Service or required by law.
In the event of a technical payment error, suspected fraud, unauthorized charge dispute, chargeback, subscription rule violation, or other payment-related discrepancy, RideSafe or the relevant payment provider/app store may temporarily suspend paid features, initiate payment verification, withhold refund execution, or block the relevant transaction within the rules of the payment provider, app store, and legislation. This provision does not apply to direct ride payments between the passenger and the driver, as RideSafe does not accept, hold, or transfer such funds.
5.5. Temporary Withholding or Blocking of Subscription or Service Fee Payments
In the event of a technical payment error, suspected fraud, unauthorized charge dispute, chargeback, violation of subscription or service fee rules, or other payment-related discrepancy associated with payment for Service access or a service action, RideSafe or the relevant payment provider/app store may temporarily suspend paid features, initiate payment verification, withhold refund execution, or block the relevant transaction within the rules of the payment provider, app store, and legislation. This provision does not apply to direct ride payments between the passenger and the driver, as RideSafe does not accept, hold, or transfer such funds.
6. Cancellation and Refunds
6.1. Subscription Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Premium features remain available until that time.
6.2. Refunds
Unless otherwise provided by law or mandatory rules of the relevant app store or payment provider, funds for an already paid subscription period are not refunded, and the user retains access to paid features until the end of such period.
The user may contact RideSafe with a request for a refund of subscription fees or service fees, if such refund is provided by law, the rules of the relevant app store, the payment provider, or the terms of the specific payment. The estimated review period for such a request is up to 14 calendar days, unless the complexity of verification, payment provider involvement, technical circumstances, or legal requirements necessitate a longer period.
If subscription or service fee payment was made through the Apple App Store, Google Play, Google Play Billing, or another app store, the procedure for cancellation, refunds, and payment dispute resolution may be determined by the rules of the relevant store or payment instrument.
6.3. Ride Cancellations
Cancellation policies for specific rides are set by drivers and displayed in the app. Frequent cancellations may result in account restrictions.
6.4. Ride Payments and Refunds Between Users
Since RideSafe does not accept or process ride payments between passengers and drivers, RideSafe does not issue refunds for such rides. Any questions regarding refunds, compensation, partial payment, or refusal to pay for a ride are resolved directly between the passenger and the driver. This does not limit the rules for refunding RideSafe subscriptions or service fees if such payments are made directly to RideSafe through available payment instruments.
6.5. Referral Program
If a referral program is available in the Service, the user may receive one month of free Service use by inviting 5 new users who registered using their referral code, met the program conditions, and were not identified as fictitious, duplicate, or created for the purpose of abuse. RideSafe has the right to establish additional technical criteria for invitation crediting, limit the number of rewards, refuse to grant a reward in case of suspected fraud, mass registrations, use of others' accounts, or other abuse, as well as to modify, suspend, or terminate the referral program with notification to users in the Service. The referral reward is not paid in cash and cannot be exchanged for money, unless otherwise expressly stated in the Service.
7. Contact Data, Communication, and Safety
7.1. Sharing Contact Data
Within the Service, a user's contact data may be disclosed to another user only in cases necessary for organizing, confirming, completing, or paying for a ride, as well as in other cases provided by the Privacy Policy or Service functionality.
7.2. Contact Data Usage Restrictions
A user who has received another user's phone number, email, payment details, or other information has the right to use such data exclusively for the purposes of the corresponding ride. Using such data for advertising, spam, harassment, disclosure to third parties, publication, or any other purposes unrelated to the ride is prohibited.
7.3. Notifications and Push Notifications
RideSafe may send the user service messages, SMS, email, or push notifications regarding registration, account login, rides, subscriptions, payments, security, complaints, Service changes, or other operational matters. The user may manage some notifications in device or Service settings; however, certain service messages may be necessary for Service operation.
8. Intellectual Property
The Service, including its content, features, and design, is owned by RideSafe and is protected under the laws of Ukraine as well as applicable international intellectual property treaties.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
9. User Content, Ratings, and Complaints
Users may create, submit, or publish information in the Service, including reviews, ratings, comments, complaints, ride descriptions, passenger rules, messages, support requests, files, or other materials.
The user warrants that such content is made in good faith, is accurate to the best of their knowledge, does not violate the rights of third parties, and does not contain threats, insults, discriminatory statements, false accusations, illegal content, or personal data of third parties without proper grounds.
RideSafe has the right, but not the obligation, to review, restrict, hide, delete, or moderate such content if it violates these Terms, legislation, the rights of other users, or may harm the safety or reputation of the Service.
Negative reviews, ratings, complaints, moderation records, and violation history are not automatically deleted upon account closure by the user. If the user re-registers or returns to the Service, RideSafe may restore or re-link them to the previous account to prevent resetting of safety history, ratings, and complaints.
By submitting content through the Service, the user grants RideSafe a non-exclusive, royalty-free, worldwide license to use such content for the operation, support, moderation, rights protection, and development of the Service.
10. Limitation of Liability
To the maximum extent permitted by law, RideSafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenue (directly or indirectly), loss of data, use, goodwill, or other intangible losses.
RideSafe is a platform that connects users but does not control or guarantee the actual completion of a ride. We are not responsible for the actions or inaction of drivers, passengers, or other users, vehicle technical condition, existence or validity of insurance, driver compliance with traffic rules, route safety, timeliness of arrival, ride payment between users, or any arrangements between the driver and the passenger.
RideSafe does not provide insurance coverage for rides, does not guarantee compensation for damages in case of an accident, cancellation, no-show, user conflict, non-payment, or improper fulfillment of arrangements between users.
Users independently assess the risks of participating in a ride, verify necessary information, comply with legislation, and bear responsibility for their own behavior, safety, and interactions with other users.
11. Indemnification
The user agrees to indemnify RideSafe, its officers, employees, contractors, and partners for any losses, expenses, claims, fines, demands, or legal costs arising from:
- the user's violation of these Terms
- violation of the rights of other users or third parties
- providing false or incomplete information
- illegal, unsafe, or dishonest use of the Service
- the driver's violation of requirements regarding driver's license, insurance, vehicle technical condition, taxes, or traffic rules
- disputes between the driver and the passenger regarding the ride, payment, route, behavior, or other arrangements
12. Dispute Resolution
12.1. Pre-Trial Resolution
The user may file a complaint through the Service functionality or to RideSafe's email specifying the ride, the nature of the violation, evidence, and contact details. RideSafe may forward the complaint to another user for explanation, temporarily restrict certain features during the review period, request additional information, and make a moderation decision within these Terms. The estimated initial complaint review period is up to 7 calendar days, and complex cases may be reviewed for up to 30 calendar days.
If you have a dispute with another user or with RideSafe, we encourage you to contact us first to attempt to resolve the situation amicably.
12.2. Governing Law
These Terms are governed by the laws of Ukraine.
12.3. Court Jurisdiction
If a dispute cannot be resolved through pre-trial resolution, it shall be subject to the jurisdiction of the competent courts of Ukraine in accordance with the laws of Ukraine.
13. Termination of Access
We may temporarily restrict, suspend, or terminate user access to the Service, individual features, or the account if the user:
- violates these Terms or the Privacy Policy
- provides false, inaccurate, or misleading information
- engages in fraudulent, dangerous, offensive, discriminatory, or illegal actions
- violates safety rules, traffic rules, or the rights of other users
- misuses contact details or payment information of other users
- frequently cancels rides, fails to show up for agreed rides, or otherwise violates arrangements with other users
- uses the Service for spam, harassment, fraud, scraping, subscription circumvention, or technical restrictions
- creates a risk to the safety of other users, Service operation, or RideSafe's reputation
Restrictions may include warnings, temporary blocking of certain features, cooldown periods, account suspension, or full termination of access. Approximate restriction timelines: warning cooldown — 24 hours to 7 calendar days; temporary feature blocking — 7 to 30 calendar days; account suspension pending review — up to 30 calendar days with possible extension for the duration of a dispute review, security incident, or competent authority request; permanent termination of access applies in cases of gross or repeated violations, fraud, use of someone else's account, block circumvention, threats to user safety, or illegal actions.
The user may contact RideSafe with a request for a refund of subscription fees or service fees, if such refund is provided by law, the rules of the relevant app store, the payment provider, or the terms of the specific payment. The estimated review period for such a request is up to 14 calendar days, unless the complexity of verification, payment provider involvement, technical circumstances, or legal requirements necessitate a longer period.
The user may also initiate account closure through Service settings, if such functionality is available, or by contacting RideSafe. Account closure does not mean automatic deletion of all usage history, ratings, complaints, disputes, or moderation records. If the user returns to the Service or re-registers, RideSafe may restore or re-link them to the previous account with the same rating, reviews, complaint history, restrictions, and other data retained in accordance with the Privacy Policy.
Upon termination, your right to use the Service ceases or is restricted in accordance with the decision made. You may also close your account at any time in settings or by contacting us, but such closure may not be used to circumvent negative reviews, blocks, ratings, complaints, or other consequences of violating these Terms.
14. Changes to Terms
We may update these Terms from time to time. The updated version is published in the Service and/or on the website with the date of the last update.
If changes are material, we may notify users additionally through the Service, email, push notifications, or other available means.
If the user does not agree with the updated Terms, they must stop using the Service. Continued use of the Service after the updated Terms take effect constitutes acceptance of such Terms.
